Ohio Sports Betting Legislation Timeline

The push to try and legalize sports betting in Ohio began in 2018 when the US Supreme Court overturned PASPA (Professional and Amateur Sports Protection Act), which clamped down on sports betting throughout the US. While many of the states around Ohio began to introduce sports betting, Ohio has been left trailing behind.

Here’s a run through of the recent progress that has been made to make sports betting in Ohio a reality:

  • December 22, 2020: The State legislature holds its final session without voting on SB111. The bill dies in. committee.
  • May 6, 2021: The Ohio State Senate releases a draft of the proposed sports betting bill.
  • June 16, 2021: By a vote of 30-2, the Ohio State Senate passes SB176, which would make sports betting in Ohio legal. The bill is then passed to the State House for further consideration.
  • August 18, 2021: Anti-gambling groups, and the Ohio branch of NAACP express their disapproval of legalizing sports betting in the state.
  • September 29, 2021: State lawmakers confirm Ohio sports betting will not launch in time to place wagers on the 2022 Super Bowl.
  • October 26, 2021: The Ohio Senate Select Committee on Gaming Chair Kirk Schuring announces the conference committee will be reporting on amendments to the sports betting legislation soon. Anticipation builds that a fresh vote could be held on the sports betting legislation in Ohio.
  • January 1, 2023: Online sports betting was legalized in Ohio

Is Sports Betting Legal in Ohio 2024?

Sports betting was legalized in Ohio early in January 2023, let’s now examine the types of betting that are legal in Ohio, as well as the ones that aren’t.

Land-based Betting in Ohio

Land-based sports betting is not available to Ohio residents, and this is unlikely to change until 2022 at the earliest. Nevertheless, the state does have casinos and racinos. Racinos is a crossover between a racetrack, and slot parlors, which don’t offer table games, such as blackjack or poker.

Until 2009, land-based casinos were outlawed, and then voters approved the creation of 4 casino licenses for the state.

Now, there are 7 racinos and 4 casinos operating in Ohio:

  • Hard Rock Casino Cincinnati (land-based casino; Hamilton, OH)
  • Hollywood Casino Columbus (land-based casino; Franklin, OH)
  • Hollywood Casino Toledo (land-based casino; Toledo, OH)
  • Jack Cleveland Casino (land-based casino; Cleveland, OH)
  • Belterra Park Cincinnati (racino; Anderson, OH)
  • Eldorado Gaming Scioto Downs (racino, Columbus, OH)
  • Hollywood Gaming at Dayton Raceway (racino; Dayton, OH)
  • Hollywood Gaming at Mahoning Valley Race Course (racino; Austintown, OH)
  • Jack Thistledown Racino (racino; North Randall, OH)
  • MGM Northfield Park (racino; Northfield, OH)
  • Miami Valley Gaming (racino, Turtlecreek, OH)

The Ohio sports betting bill would also pave the way for 33 licenses to be created for land-based sportsbooks, including casinos and racinos.

Horse Racing & Off Track Betting

In Ohio, horse racing is permitted both online,  as well as through the state’s seven racinos, and a single OTB (off-track betting) location. Video lottery terminals (VLTs) have also been legal at Ohio race tracks since 2011.

The Ohio Racing Commission regulates and oversees all parimutuel and horse wagering in the state. Most mainstream horse racing betting sites, such as TwinSpires and TVG, accept wagers from Ohio residents.

Alternatively, you can always bet on horse races through our recommended sportsbooks.

Offshore Online Betting in Ohio

While there are hurdles to be cleared before sports betting is legal in Ohio, bettors can still make wagers using an offshore sportsbook. As mentioned, most of these sites will be based in Costa Rica, Curacao, or the EU, and therefore they are not under the jurisdiction of the Ohio state government. So, while the sites are not technically allowed to operate in Ohio, betting with them is entirely legal.

Even if sports betting in Ohio isn’t legalized, offshore betting will continue in its current format. So, if you are looking for legal sports betting in Ohio, then check out the sites we have listed at the top of this page.

Are DFS Legal in Ohio?

Daily fantasy sports are legal in Ohio. Although sports betting has yet to materialise in Ohio, a state law passed in 2018 which made DFS exempt from being controlled by the state’s gaming commission. In 2020, the gaming commission announced it had granted licenses to 5 daily fantasy sports sites:

  • FanDuel
  • DraftKings
  • Yahoo Fantasy Sports
  • StatHero
  • Fantasy Golf’s OG

However, you are only to bet at the five aforementioned sites. You therefore can’t play DFS at sites such as Monkey Knife Fight that haven’t been awarded a license by the Ohio gaming commission.

Casino Laws in Ohio

There have been a number of changes to the casino laws in Ohio in recent years. Before 2009, the state only allowed racetracks, and they had just one off-track betting site outside the existing 7 tracks.

However, in 2009, voters and the state legislature approved the creation of 4 licenses for land-based casinos. Then, in 2011, the introduction of slot machines and video poker to the state’s racetracks were permitted, turning them into ‘racinos’.

Casinos would benefit from any changes to the Ohio sports betting landscape, as all casinos and racinos in the state could open sportsbooks. They would then serve as partners for any online sportsbooks that want to operate in the state.

Online Casino Sites

There are currently no online casinos in Ohio. However, Ohio residents can still play with one of our recommended online casinos. Overseas casinos are well covered in terms of supplying the best slots titles, as well as plenty of baccarat, blackjack and live dealer tables.

For the best Ohio casino experience, we suggest you take a closer look at Wild Casino, Bovada Casino, and BetOnline Casino.

Land Based Casinos in Ohio

As mentioned previously, there are 4 land-based casinos, and 7 land-based ‘racinos’ operating in Ohio:

  • Hard Rock Casino Cincinnati (land-based casino; Hamilton, OH)
  • Hollywood Casino Columbus (land-based casino; Franklin, OH)
  • Hollywood Casino Toledo (land-based casino; Toledo, OH)
  • Jack Cleveland Casino (land-based casino; Cleveland, OH)
  • Belterra Park Cincinnati (racino; Anderson, OH)
  • Eldorado Gaming Scioto Downs (racino, Columbus, OH)
  • Hollywood Gaming at Dayton Raceway (racino; Dayton, OH)
  • Hollywood Gaming at Mahoning Valley Race Course (racino; Austintown, OH)
  • Jack Thistledown Racino (racino; North Randall, OH)
  • MGM Northfield Park (racino; Northfield, OH)
  • Miami Valley Gaming (racino, Turtlecreek, OH)

Casinos will offer classic table games, such as blackjack, roulette, and poker. Racinos, meanwhile, are horse tracks that also have slots and video poker on site, but they aren’t licensed to offer table games.

Ohio Gambling Tax

All casinos and racinos in Ohio are subject to a 33% tax on gross revenue. For individual gamblers, figuring out how much you owe is more complicated.

If you bet at a state-licensed casino or racino, these establishments are required to withhold 4% of player winnings in taxes. However, your actual tax rate may be higher or lower depending on the income bracket you fall into. So, when you’re filing your state income taxes, you’ll need to calculate how much you owe and then subtract the amount withheld by the casino.

You can deduct gambling losses from your income when calculating federal taxes, however, you can’t deduct more than you’ve won. Offshore betting sites don’t withhold any of your winnings for tax purposes. You will therefore have to report any net earnings from gambling at these sites on your state taxes.
